Our company was supposed to deliver a shipment of a cereal from Canada to the Iraq, which was being purchased by an Iraqi ministry. The contract calls for arbitration under an Iraqi law. After posting the performance bond, the Iraq ministry opened the letter of credit late, and the letter of credit was missing nearly USD 1 million. When we complained, the Iraqi Government took the performance bond. We went to the lower courts of Iraq, where we won, and the Government appealed. We also won at the level of the Court of Appeal, and the Government appealed to the Court of Cassation. The Court of Cassation found for the Government in a decision that may have been influenced by corruption, and we were ordered to pay USD 13 million for failing to deliver the shipment of the cereal, although the Letter of Credit was never opened properly . We decided to ask for arbitration, which was called for under the contract, but the court held that we had waived our right to arbitration, since we did not seek arbitration at the beginning of the case. Now we would like to bring an ICC arbitration against the Iraq Ministry, on different grounds, seeking the refund of our performance bond. We do not want to return to the courts of Iraq, since they are very bad.

SKH, of Indian origin, was a foreign investor in Bangladesh for over two decades. He invested in a large garment factory that came to be known for delivering premium quality value-added apparel to Portugal/Turkey/South China for many well known brands in the upper mid to upper class product bracket. The garment factory HS created had an annual capacity of 1.6 million garments and was located in an EPZ free trade zone in Bangladesh. The amount invested in the company was equal to approximately USD 3 million, and the company itself had a value of approximately USD 5 million at the time of expropriation. He needs funds to bring a case for the illegal actions. The workers in the EPZ did not provide the fair and equitable treatment that was required under the India-Bangladesh BIT, and the factory was indirectly expropriated for no compensation and HS was deported from Bangladesh to India. Compensation for Bangladesh’s treatment, and damages of USD 5 million plus interest, are being sought from Bangladesh. 35% of compensation is offered as a reward.
