Sears failed to provide Discloure to its Franchisee’s in accordance with the Arthur Wishard Act, when it Sold the business to a third Party SHS Services Management Inc.)
SHS Services Management Inc puts itself in Receivership 10 months later resulting is millions of dollars is losses to the Franchisees.
Throughout the transaction Sears Breached its duty of Fair Dealing with the Franchisees and Breaching multiple clauses in the agreement while they used the Receivership to terminate the Franchisee agreements and force the Franchisees to re sign new agreements designed to relaunch the program as sub contractors and avoid any protections the Franchisees had under the Wishard Act.
Please help us make sure Sears does not get away with the willful destruction of our long standing businesses.
