Description Of Legal Dispute
Minority Hindu Woman raped by fraudulent means by Local U.P Chairman without any martial tie at Savar Upazila- Country : Bangladesh

Facts in Brief: On 23.12.2014 at about 11 at night Hafizur Rahman went to rented- house of victim, knocked the door, as soon as the door is opened perpetrator caught hold of victim, forcefully opened wearing clothes and started to rape on the bed despite resistance made by her and he left her home abandoned threatening her not publicize thereby cheated her to become her husband. The victim finding no other alternative went to the house of Hafizur Rahman Sohrab asking for legal marriage as she lost chastity due to sexual intercourse but on the contrary she was then physically assaulted and kicked her to leave the house. Thereafter she lodged first information report (F.I.R.) at Savar Sadar Police station against the perpetrator-Chairman on 19.01.2015.
Investigation :
Advocate and Human rights defenders (They) rushed to the place of occurrence on 23.01.2015 at about 3 p.m. visited the spot, police station, met with Officer in Charge and the Investigating officer of the respective case. They also went to see the victim but at that time the victim was disappearing because of threat made by perpetrator-Chairman. They also went to the house of perpetrator who was arrested on 19.1.2015 by police, but we found Ms.Shelina Rahman (40) wife of Hafizur Rahman denied any involvement of her husband with rape scenario. We also found witnesses examined present witness namely 1) Mollah Abul Hossain, 2) Billal Hossain, 3) Md. Abbas Ali Khan, 4) Md. Dulal, 5) Md. Mazibur Rahman, 6) Ms.Selina Rahman, 7) Hajee Abdur Razzak (55) Owner of the Building Some of the witnesses present in the house of perpetrator was canvassing that the victim was a bad and prostitute lady. But those witnesses could not make us understand providing any evidence how victim became prostitute. They also went to a destination where the victim was absconding for fear of life, we met with her and she narrated the story as follows: ” Since long after my legal marriage with Hindu husband, perpetrator- Md.Hafizur Rahman was eve-teasing me for sexual desire, he without any martial relationship fraudulently kept sexual tie, induced me to have sexual intercourse by personating my husband committed rape several times without any valid documents, I (Victim) have one children aged about 7 years, Md.Hafizur is greedy person and debauchee who had been influencing me showing his position as Chairman of the Union Council raped me several times without my consent. I (victim) could not disclose his nasty habit as I (victim) along with my Hindu husband was threatened by him for life, Lastly on 23.12.2014 Md.Hafizur brought a non-judicial stamp and compelled my husband to put signature on blank stamp paper created a fraudulent papers for divorce which was not at all done with my consent. Now I (Victim) have been shelter less, homeless and destitute soon after Md.Hafizur refuses to marry me physically assaulting in his house – I need your legal assistance for protection of my right to life and right to integrity, right to food”
Case Summary : Ms. Nupur Goswami Hindu woman was a Brahmin by caste lives at Suapur Union of Dhamrai Upazila of Dhaka District. Similarly the house of Md.Hafizur Rahman was half kilometres In this opportunity powerful Chairman Hafizur most secretly made up a plan to capture this Hindu woman by alluring her bright future and started to keep physical relationship with the victim compelling her to abandon relationship with Hindu husband. Sexual relationship started since one year before, but cunning Md.Hafizur Rahman Shohrab (45) without any martial relationship fraudulently kept sexual tie, induced with Ms.Nupur Goswami to have sexual intercourse by personating her husband committed rape several times without any valid documents and thus committed crime against women and children under the law. Ms.Nupur lodged F.I.R. at local Savar Police station against Hafizur having been cheated and also physically assaulted by local Chairman. The victim was firstly neglected by her Hindu husband and secondly she was raped and physically assaulted by local U.P. Chairman rendering the life of this minority women in a unending miseries & disgraceful situation. Nether she is capable to go back to his previous Hindu husband nor she is entertainable in the Muslim society. Society now branded her as prostitute.
Recommendations :
Human rights defenders is very much concerned about this incident of rape with dubious means on minority woman confining her in solitary room and we demand-
1) Immediate protection of minority victim and her family members so that they can stay at their home without any hindrances.
2) Local police should bring back the victim and her family members who were threatened by powerful perpetrators to live their home.
3) The rights of women and children belonging to minorities should be protected.
4) The minority victim should be given proper medical assistance to recover from traumatized position. Special care by the state should be ensured.
5) Compensation to the victim should be paid by the State.
6) The perpetrator should be brought to book as per law making scope to render the criminal to suffer maximum punishment.
7) Bail of the perpetrators by Lower judiciary & High Court Division of Supreme Court of Bangladesh in such a heinous crime should not be encouraged.
8) The Government of Bangladesh has also signed and ratified various international human rights instruments, such as Convention on the Elimination of all forms of Discrimination against Women (CEDAW) but in this case it was violated. Violation of ratified human rights instrument should not be entertained.
9) Inordinate delay in accepting the F.I.R. by police is serious lapses on the part of police and the person responsible for dilatory tactics jeopardising the interest of victim should be called for explanation.
10) Chairman of Union Parishad is responsible post – He has been entrusted with responsibility to protect their citizen as per law, but the Chairman took law in his hand and committed crime against humanity and as such he is liable to be punished.
