Litigation Funding: Enforcement of Swiss Arbitration Award

A few years ago, a university in Slovakia –Zilina University- leased vacant premises to the litigant. However, the university ended the lease agreement after only 6 months. The plaintiff was entitled to receive damages and compensation; anyhow Zilina University rejected the settlement and put a stop to further negotiations.

Therefore, the litigant submitted a Request for Arbitration and won. As explained in the case description, the compensation and damages amount to:

       Loss of Profit: 132, 043.88€

       Damages: 13,205.39€

       Costs: 5,932,45€

Because of an Amendment that came into effect in 2015, the award was no longer recognized. The plaintiff needs to raise money to appeal against this decision. Because the university is a public institution, suspicion is raised around the fact that it could be beneficiating from preferential treatment. They feel apprehensive about possibly bringing the lawsuit to the Supreme Court.
