Description Of Legal Dispute
We have been involved in an ongoing dispute resolution process with a major Government entity.
The entity has admitted wrongdoing through their internal dispute resolution process and made an offer of compensation.
The issue is not the admission of wrong doing the issue is quantifying the damages to a more substantial figure that is fair and equitable.
We have received an opinion from a barrister highly experienced who believes the matter can be pursued in the Federal Court to pursue a larger damages payment.
Currently we are preparing the briefs for the barrister and engaging expertise to write the brief on the quantum of the damages. We expect this figure to be in excess of $10million.
Our current need is to fund the initial briefing process and some preliminary preparation. We have already submitted some material to a large litigation funding company , who have expressed strong interest in funding the process once the full brief is prepared, the expert paper on the quantum is documented and the barrister then confirms the liability that will be pursued.
We expect to finalise this litigation funding prior to Christmas 2015 if we can ensure we have funding to prepare the necessary preliminary material.
As the organisation we are litigating has already admitted wrong doing and made an offer of compensation, we believe by pursuing them with an aggressive action in the Federal Court the strategy will be to force a larger settlement prior to going to court. We cannot guarantee it will not go to court, but the strategy is designed to force them to consider facts more reasonably or risk the public exposure of the wrongdoing as well as the neutrality of the legal system to decide the damages amount.
