Litigation Against Germany For Illegal Expulsion Of Palestinian Student On Basis That He Was A “Terrorist” (This Was False As The German Constitutional Court Subsequently Recognized)
Mr. YM was a Palestinian student who was illegally expelled from Germany of Palestinian origin in 1972. A constitutional decision was rendered in this respect, but Germany has never paid him compensation for its wrongful act, which caused him considerable troubles.
He would be glad to reward donors, but as he is not aware of the precise amount of compensation he is owed, he is merely requesting donations.
Mr. YM was born in Palestine and was a refugee in Syria, where he attended high school. In 1960, he went to study in Germany, where he studied medicine. In 1972 he was at the Olympiad in Germany, and the Government of Bavaria ordered his deportation simply because he was Palestinian, and the group that had performed the terrorist acts at Munich was Palestinian. Mr. YM had nothing to do with this, as a German Constitutional Court Decision subsequently found, which also ruled that his deportation was illegal (too late, of course, since his life had already been shattered).

Mr. YM was shocked and very depressed to learn about his deportation, which interrupted his studies of medicine, and his peaceful life was destroyed due to his illegal deportation. The police took his passport and the general student committee hired the lawyer who had defended Nelson Mandela in South Africa.
After a series of court decisions and appeals, the Supreme Court in Germany made the first decision following World War II against the Government, put two days before the decision the police deported Mr. YM to Damascus, Syria, in any event.
There, the German embassy had sympathy for YM’s case. Mr. YM managed to return to East Germany, and the Supreme Court indicated that the Government of Bavaria should compensate Mr. YM for the consequences of his illegal deportation. Mr. YM’s first lawyer, who died in an accident, had the strategy to start with a claim in Germany, and then to apply to the European Court of Human Rights to obtain compensation if it was refused. This lawyer died in an accident, however. He is searching for a new lawyer with experience in human rights law.

Mr. YM ended up working for the Red Cross in Palestinian refugee camps following his problems with Germany. His goal is simply to obtain reasonable compensation for constitutional violations by Germany before he dies, since he is old now.
